Fighting against deportation

Many immigrants in Pennsylvania might be concerned about the possibility that they may one day face deportation proceedings. Immigration officials changed their approach toward deportation in 2011, and the closest scrutiny is now reserved for those who have committed serious crimes or are suspected of being involved in terrorist activity. However, immigrants who do not fall into these categories often still face deportation over matters such as violating the terms of a visa or overstaying a visa.

If you are facing deportation or you have received a notice to appear before a removal hearing, you have certain legal rights. You may retain an attorney to advocate on your behalf, and you have the right to scrutinize all evidence presented by immigration authorities as well as question any witnesses who testify against you. You may also appeal the decision of an immigration court in federal court.

There are a number of factors that could make deportation less likely. For instance, your length of residence in the country, moral character and prior immigration violations history might influence your case. Other factors that may be considered could include your employment history and the likelihood that you would face persecution if a deportation order was issued.

The prospect of facing deportation is a persistent fear for many immigrants. If you are in this situation, our attorneys at the Law Office of Troy J. Mattes, P.C., may be able to advise you regarding your case and the steps that you could consider taking.
