How to transition from student to work visa

On Behalf of | Oct 1, 2024 | Visas |

Transitioning from studying to working in the U.S. marks a significant milestone in your professional journey. Here are some tips on what to do to change your student visa to a work visa:

  • Finish your degree: Complete your studies while following all F-1 visa rules.
  • Use Optional Practical Training (OPT): After graduation, get work experience in your field for up to a year. STEM graduates can extend this by 24 months. Apply for OPT using Form I-765 and obtain an Employment Authorization Document.
  • Get a job offer: Find a U.S. employer willing to sponsor your work visa and start your job search early.
  • Apply for an H-1B visa: This work visa is for specialized jobs. Your employer must file paperwork with the Department of Labor and the USCIS (U.S. Citizenship and Immigration Services).
  • Know the timeline: H-1B applications start on October 1st, and visas in April. Plan to meet deadlines. If your OPT ends before your H-1B starts, you may qualify for a “cap-gap” extension.
  • Follow the rules: Keep your immigration status valid and obey all regulations. Breaking rules can hurt your chances of getting a work visa.

By understanding these steps, you can smoothly switch from a student to a work visa and grow your career in the U.S.

Keep in mind that H-1B visas have a yearly limit. More people apply than there are visas. This means you enter a lottery. Your chances of getting a visa can change each year. It’s wise to have a backup plan. Talk to others from your school who’ve made this switch. They can give you good advice and job leads. Lastly, consider talking to an immigration lawyer who can explain the process better.
